Terms of Service

Your account

• Eligibility. You must be at least 16 years old, or the minimum age of digital consent in your jurisdiction, whichever is higher.
• Accuracy. Provide accurate account information and keep it current.
• Security. You are responsible for keeping your sign-in credentials and model API keys secure. Notify us promptly if you suspect unauthorized access.

Acceptable use

You agree to use Mindvary only for lawful purposes. You will not engage in abusive behavior toward Mindvary users or staff, attempt to disrupt the service, or use Mindvary to bypass another provider's terms of service. When you connect a third-party model provider, your use of that provider is also governed by their terms.

Billing & refunds

• Subscriptions. Paid plans are billed monthly and renew automatically until cancelled.
• Cancellation. You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period.
• Refunds. We do not offer refunds for partial months. You retain access until the period you have paid for ends.

Intellectual property

You own all content you create with Mindvary, including conversations, prompts, library contents, and outputs you generate via your own model keys. Mindvary retains ownership of the software, brand, and underlying infrastructure. You grant us a limited license only to the extent necessary to operate the service for you (e.g., syncing your encrypted data across your devices if you enable cloud sync).

Service availability

Mindvary is provided on a best-effort basis. We do not offer a service-level agreement (SLA) on the Free tier. Paid tiers may include availability commitments described separately in your subscription.

Limitation of liability

To the maximum extent permitted by law, Mindvary's aggregate liability to you for any claim arising out of or relating to these terms is capped at the total fees you paid us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.

Termination

Either party may terminate this agreement at any time. You can delete your account from your settings. We may suspend or terminate accounts that violate these terms. Sections intended to survive termination (intellectual property, limitation of liability, governing law) will continue to apply.

Governing law

These terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws principles. Final venue and arbitration provisions are pending legal review.
